Three-Cornered Possession Case A three cornered possession case came before the magistrate (Mr W. C. Harley in the Whangarei Court today. George Shanks claimed possession of a house from William John Humby. Ernest Poole claimed possession of another house from Mervyn Alfred Low and Humby claimed possession of a third house from Poole. The cases arose out of the occupancy of three houses at Onerahi and one in Maunu Road, said Mr D. J. Thomson, who appeared for Poole. Alternative accommodation had been found for Low but it was not now available. 'There is only one answer to this and that is for the whole issue to club together to find a place for Low. who is 'the odd man out,' said the magistrate (Mr W. C. Harley) after hearing evidence. He adjourned all three cases sine die to be brought on on 48 hours’ notice. 'I am bound by the regulations and I have no arbitary powers to start off this shunt. The only thing for a landlord to do is to provide alternative accommodation unless there is hardship.' |

| Farm Manager Stole Stock For Nine Years, WHANGAREI, Aug. 24. A farm foreman pleaded guilty to 55 charges, 53 of them for stealing cattle and pigs, when he appeared before Mr J. R. Herd, S.M., today. He was Mervyn Alfred Low, aged 47, ex-manager of a farm owned by D. K. and N., D. Ross at Three Mile Bush. Detective-Sergeant L. F. O’Shea said that the total amount of the property involved in the 55 charges was £2645 5s lOd. The offences had been committed over a period of nine years. Mr O’Shea said that Low had been appointed manager of the farm' before 1955 and in that year he began to drink and gamble heavily. Low then started selling stock off the Ross farm and keeping the money. He had no authority to do this and as the years went by he found it easier and easier to sell stock and get away with it. Mr O’Shea said that to cover up his activities, Low falsified the stock musters and he sold most of the livestock through stock firms-in Whangarei who were under the impression that he was a 50 per cent shareholder in the Ross farm. Deficits. This continued until last year, said Mr O’Shea, when Low became alarmed at deficits in the milking returns. To help counteract this, Low bought a number of milking cows but found he could not meet the payments on them. In 1962 he let an area of the farm for grazing by other farmers and received £4l. in return, which he kept for himself. On other occasions he stole sums of money from a wardrobe to Mrs Ross’s house. Mr O’Shea said that Low had recently declared bankruptcy, and when he did this he also went to the Whangarei police and made a full and frank confession. He is alleged to have told the police that drink and gambling were his downfall. Low, who had nothing to say in court today, was convicted and remanded to custody for sentence on Thursday. The Magistrate called for a probation officer’s report. Low was not represented. |

| Farm Foreman Gaoled On 58 Charges WHANGAREI, Aug. 27th Mervyn Alfred Low, aged 47, farm foreman, who earlier this week was convicted by Mr J. R. Herd, S.M., on 55 charges of theft and three charges pertaining to bankruptcy, was sent to prison for two years when he appeared for sentence today. Previously Low had pleaded guilty to 53 charges of stealing cattle and pigs from the farm at Three Mile Bush where he was employed. The offences took place over a period of nine years. He had also pleaded guilty to three other charges of theft of money. Three charges involved in Low’s declaration of bankruptcy and to which he also pleaded guilty this week, were all dealt with in the same sentence. The Magistrate said that the sentence would total two years, six months on each charge with 52 of the terms being concurrent and the last three cumulative. He told Low that he considered this to be a moderate sentence in view of the seriousness of the charges and the time over which they were committed. |
