WILL

I GEORGE WADDEL of Te Aroha in New Zealand Declare this to be my last WILL
I appoint my son-inlaw Brono Cordes of Te Aroha Cabinet maker and George Ashe Milk vendor (herein after called my Trustees and Executors of this my WILL.)

I GIVE DEVISE AND BEQUEATH all my estate both real and personal unto my Trustees apon trust to sell call in and convert the same into money with power to my trustees to postpone such sale calling in and conversion the whole or part or parts of my estate untill such time or times as they think fit whithout being responcible for depreaciation or loss incurred
And to pay and devide the proceeds of such sale calling in and conversion equally to and among my children alive at the time of my death
DECLARING that if any child of mine shall predecease me leaving lawfull issue who shall survive me, such issue shall take and if more than one equally the share which his her or their parents would have taken had he or she survived me
AND DECLARING with regard to monies falling to minors that my Trustees may at that descretion pay or expend the income or the capital thereof for the maintainence education and benifit of such minors respectively. And I Declare that my Trustees may lease or Mortgage my estate or any part thereof.

this seventeenth day of November One thousand nine hundred and twenty five.

This is the codicil now produced and shown to Bruno Cordes of Te Aroha Cabinet Maker mentioned and refered to in his annexed affidavit to lead to a grant of Probate to himself and George Arthur Waddel. Sworn at Te Aroha this ninth day of September 1941 before me:

CODICIL

I GEORGE WADDEL of Te Aroha in New Zealand Declare this to be a Codicil to my WILL bearing the date the seventeenth day of November One thousand nine hundred and twenty five.
I REVOKE the appoint of George Ashe of Te Aroha Milk vendor as a Trustee and Executor of my said WILL and in his Stead
I APPOINT George Arthur Waddel of Whenuapai Engineer to be one of my Trustees and executors to act in conjuction with Bruno Cordes of Te Aroha Cabinet maker
I BEQUEATH to my daughter Irene Gladys Johnson such of my furniture and personel effects as may be in her house at the time of my death
AND SUBJECT thereto I confirm my said WILL.

In WITNESS whereof I have Hereunto subscribed my name
this twenty ninth day of March One thousand nine hundred and thirty three.

Affidavit

We BRUNO CORDES of Te Aroha in New Zealand, Canbinet maker
and GEORGE ARTHUR WADDEL of Whenuapai in New Zealand, Engineer
severally make Oath and say as follows:-

1. That we knew GEORGE WADDEL late of Te Aroha aforesaid
retired Baker deceased, when alive and that the said George Waddel was resident or domicile at Te Aroha

2. That the said George Waddel died at Hamilton on the 14th day of August 1941 as we are able to depose from having attended his funeral.

3. That we believe the typewritten documents now produded bearing the date 17th day of Novenber 1925 and 29th day of March 1933 respectively to be respectively the last Will and Testiment and a codicil thereto of the said deceased and that we are the Executors therein named.

4. That we wil faithfully execute the said WILL and Codicil by paying the debts and legacies of the said deceased so far as the property will extend and the Law binds and whenever ordered so to do after the grant of Probate to us, file in this Court and verify by affadavit a true and full and perfect inventory of all the Estate effects and credits of the said deceased which shall come into our hands possession or Knowledge and also a full and distinct and proper account of our execution of the WILL and Codicil which shall set forth the dates ans particulars of all receipts and disbursements ans show which of the same are, in our opinion, on account of capital and account of income respectively.

5. That according to our knowledge and belief the estate and effects of the said deceased in respect of which probate is sought to be obtained are under the value of:- £700

6. That I the said Bruno Cordes was born in Auckland in New Zealand
and am a British Subject by birth and am not and never been an alien enemy within the meaning of the said Regulation.

7. That I the said George Arthur Waddel was born in Auckland in New Zealand
and am a British Subject by birth and am not and never been an alien enemy within the meaning of the said Regulation.

8. That we were severally informed by the deceased in his lifetime that the deceased was born at Auckland aforesaid and we verily believe that the deceased was never an alien enemy within the meaning of the said Regulation.

9. That according to our knowledge information and belief based apon the results of our enquiries and particularly upon the information referred to in the proceeding paragraph hereof the said George Waddel deceased was not at the time of his death an alien enemy within the meaning of the said Regulation.
